Emerging Trends in Privacy and Data Protection Regulation

In both the U.S. and abroad, there is an increased focus on the need to protect personal data. This program will provide an overview of the applicable legal framework in both the United States and the European Union. In the U.S., there is no comprehensive privacy law. Instead, Congress has taken a sector-specific approach with specific statutes governing financial privacy, health privacy, and certain other areas. The Federal Trade Commission has filled in the “gaps” using its authority under Section 5 of the FTC Act to enforce unfair and deceptive trade practices. In contrast, the European Union has had comprehensive data protection regulation that broadly protects the personal data of consumers, employees, and other individuals. But the landscape in Europe also is evolving. This past year, the European Commission has adopted the General Data Protection Regulation (or “GDPR”), which toughens the penalties and the substantive obligations applicable to companies that process personal data.
