Side Effects May Include Longer Commercials: The Coming Fight Over DTC Advertising
Thursday, October 29 | 11:00 a.m.-12:30 p.m. | Webinar
FDA is considering rulemaking that could fundamentally reshape DTC advertising by eliminating the “major statement” and “adequate provision” paradigm for broadcast advertising of prescription drugs. Practically, this would require substantially more disclosure of risk information to appear in broadcast ads for prescription drugs, potentially making them infeasible. Such a change could have significant legal, practical and economic implications for biopharmaceutical companies, broadcasters and others involved in DTC advertising.
Join us on October 29 for “Side Effects May Include Longer Commercials: The Coming Fight Over DTC Advertising,” where our experts will explore what the potential rule could entail, the political and procedural dynamics that may shape an accelerated rulemaking process, and the First Amendment, statutory and administrative-law issues likely to arise in any legal challenge.
Additionally, we’ll discuss industry reactions and explore the practical question at the center of the debate: If the rule is finalized, can DTC television advertising adapt — or would companies need to rethink the medium altogether?
